Terms of Service and Privacy Policy

These Terms of Services (“Terms”) are a binding contract between you and MICC Financial Inc. (referred to as “Miq,” “we,” us,” or “our”) to your access and use of our Miq Platform and Services. We have prepared these terms to describe to you our practices regarding the user terms and conditions for the use of our website and platforms at getmiq.io, web-based application, and our Mobile App (collectively the “Platform”).

Miq is a technology platform that enables cooperatives and community organizations to embed financial services, reward programs, and collaborative administrative functionality as a licensed product.

By accessing or using our Services, you hereby agree that you have read, understood, and agree or consent to be bound by these Terms and our Privacy Policy. If you do not agree with or consent to the Terms or our Privacy Policy, you are not authorized to use our Services.

By accessing or using our Services, you acknowledge using the Miq Services only as outlined in these Terms for the facilitation, organization, and support of social payments and collaborative or community-based financial activities.

Access to Accounts, Services, and Platform

You agree and warrant to us that:

  1. You are at least 18 years of age.
  2. You have not previously been suspended or removed from our Services.
  3. Your registration and use of the Services comply with all applicable laws and regulations.
  4. If you are using the Services on behalf of an entity, organization, or company, you represent and warrant that you have the authority to bind that entity, organization, or company to these Terms and that you agree on behalf of that entity, organization, or company to be bound by these Terms.

User Conduct and Interaction

Miq is a collaborative, community platform.

As a specific condition of your use of any of the Services and Platform, you explicitly agree not to:

  1. Use any of the Services for any purpose that is unlawful or prohibited by these Terms.
  2. Intentionally submit or transmit inaccurate information through the Services and/or Platform.
  3. Impersonate or pretend to be anyone else while using the Services and/or Platform.
  4. Use the Services in any way that could damage, disable, overburden, or impair any of the Services, or interfere with anyone else’s use of any of the Services.
  5. Attempt to gain unauthorized access to Miq’s computer systems or networks connected to Miq, through hacking, password mining, or any other means.
  6. Attempt to reverse engineer any portion of any of the Services or attempt to infringe the intellectual property rights of others in any way.
  7. Obtain or attempt to obtain any materials or information through any means not intentionally made available through any of the Services.
  8. Attempt to circumvent any content-filtering techniques we employ or attempt to access any feature or area of our Services that you are not authorized to access.
  9. Introduce any malicious or technologically harmful material into our Services.
  10. Develop or use any third-party applications that interact with our Services without our prior written consent, including any scripts designed to scrape or extract data from our Services.
  11. Use our Services for any illegal or unauthorized purpose, or engage in, encourage or promote any activity that violates these Terms.

Ownership

All rights, title, and interest (including all copyrights, trademarks, and other intellectual property rights) in the Services and any materials provided, contained in, or made available for use in connection with the Services, Product, and Platform belong to Miq.

Further, all names, designs, graphics, data, images, pictures, logos, and icons on the Services and the Materials are proprietary information or proprietary marks of Miq or the original creator of the material.

You are hereby granted a personal, non-exclusive, non-transferable, limited license to use the Services in accordance with these Terms. You are not allowed to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained directly from the Services (including the Materials).

Further, you may not reproduce any part of the Services (including the Materials), and any such violation with respect to the Services will terminate the license(s) granted herein.

MICC Financial Inc. (referred to as “Miq,” “we,” us,” or “our”) is committed to protecting your privacy and the confidentiality of your personal information in our procession and control. We have prepared this Privacy Policy to describe to you our practices regarding the personal information we collect from users of our website at getmiq.io, our web-based application, and our Mobile App (collectively the “Platform”).

This Privacy Policy explains the measures we take to fulfill these commitments and describes how Miq collects, uses, maintains, discloses, and otherwise treats the personal information of our users as well as through other products and services offered by Miq (collectively the “Services”) and other interactions with our clients and prospective clients.

What Information Do We Collect?

Information is collected through your interactions and use of our Services, Platforms, and interactions with partners. This information is used to provide our services to you. Miq collects your name, date of birth, email, residential address, telephone number, government ID information, social insurance number, occupation, employer, and banking account.

We ask you for your personal information for the following purposes:

  1. To register and administer our services and resolve issues relating to our Services or Platform
  2. To provide accurate transaction services to users.
  3. To verify your identity and protect your community against fraud.
  4. To retrieve all payment data and build user credit.
  5. To understand how communities and our users use the Services and resources provided on our Platform
  6. For research and analytics to improve the Services, to improve the usability, function, and engagement of our Platform using nonidentifiable data.
  7. To detect and prevent fraud for legal compliance purposes, to enforce our agreements with Users, and maintain business records.

If you create an account, you agree that we may verify your name, address, phone number, and other account details with information about you held by a third party or publicly available sources (such as identity verification providers, fraud prevention services, government registries, and your mobile service provider) to verify your identity and help protect against potential fraud. You provide your consent for them to disclose and/or compare your information for this purpose. Your personal information will not be shared with these third parties for any other purpose.

Your Consent: By using the Site, registering for or obtaining a Service, and/or providing us with personal information, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy.

Access to your user account, your personal information, and the MIQ platform is protected with a password you select. We strongly recommend that you do not disclose your password to anyone. We will never ask you for your password in any unsolicited communication (such as letters, phone calls, or email messages).

Termination of Account

Notwithstanding anything contained in these Terms, we reserve the right, without notice and in our sole discretion, to terminate your right to access or use the Services and Platform at any time and for any or no reason, and you acknowledge and agree that we shall have no liability or obligation to you in such event and that you will not be entitled to a refund of any amounts that you have already paid to us, to the fullest extent permitted by applicable law.

Personally-Identifiable Information:

We may collect personally-identifiable information when you specifically and knowingly provide it to us, for example, when you access the Services and Platform. Without information about you, we may not be able to provide you with the Services or the support you request.

Website Use and Technologies:

When you use the Services, Miq, third parties on our behalf may collect non-personally identifiable information via the use of pixels, programs, cookies, and other similar technologies.

We also use service providers to perform specialized services such as data hosting, processing services, banking, payment processing services, digital support, and mail distribution. Our service providers may be responsible for processing personal information. They are provided only the information necessary to perform the service. We require that our service providers protect your information in accordance with our Privacy Policy and security practices.

What Do We Do With The Information That We Collect?

Except as disclosed in this privacy policy, Miq does not share your personal information with any outside parties. Miq does not sell, rent or lease its customer lists to third parties.

Miq will use the personally-identifiable information directly submitted by you and your User Content solely for the purpose for which you have provided it, such as processing transactions (including related communications); providing notices (notifications), updates, security alerts, and support; providing third-party access to your User Content as provided for on the Services or as needed to complete any Services.

If you create an account, you agree that we may verify your name, address, phone number, and other account details with information about you held by a third party or publicly available sources (such as identity verification providers, fraud prevention services, government registries and your mobile service provider) in order to verify your identity and help protect against potential fraud, such as when someone other than you is trying to use your account or conduct a transaction without your permission, and you provide your consent for them to disclose and/or compare your information for this purpose. Your personal information will not be shared with these third parties for any other purpose.

Third parties to whom we disclose information

Miq does not sell, rent or lease its customer lists to third parties. We may disclose personal information we collect online to the following categories of third parties:

  • Credit Bureaus: Miq may disclose some or all of the information you provide us to credit bureaus (i.e. Equifax and TransUnion) to provide our services and help you build a credit history. This may include your name, address, social insurance number, and information about your loan balance and payments. The information provided to credit bureaus may be used in consumer credit reports. Credit reporting and credit reporting agencies are regulated by provincial and territorial governments. The Personal Information Protection and Electronic Documents Act (PIPEDA) outlines the requirements for organizations that use, collect or disclose personal information during the course of their business activities, and credit bureaus may only use and disclose personal data subject to applicable legal restrictions and requirements.
  • Legal Compliance and Security: In certain exceptional cases, we may disclose your personal information when we have reason to believe that disclosing this information is necessary to identify or contact you or bring legal action against someone who may be causing injury to you; Miq, or someone else. We may disclose your personal information when we believe the law requires it, in response to any demand by law enforcement authorities in connection with a criminal investigation, in response to civil or administrative authorities in connection with a pending civil case, governmental authorities or administrative investigation, or in connection with an investigation conducted by Miq.
  • Disclosure - Credit Bureaus - Both positive and negative payment history are reported to the credit bureaus.

Content and Information that you provide as a User

ANY OPINIONS EXPRESSED IN ANY SUCH USER-SUBMITTED CONTENT ARE SOLELY THOSE OF THE USERS THAT SUBMITTED THE CONTENT AND DO NOT NECESSARILY REFLECT THE OPINIONS, POLICY, OR POSITION OF MIQ.

USERS ASSUME ALL RISKS ASSOCIATED WITH SUCH CONTENT, INCLUDING, BUT NOT LIMITED TO, ANY THIRD PARTY’S RELIANCE ON ITS QUALITY, ACCURACY, OR RELIABILITY, OR ANY DISCLOSURE OF INFORMATION IN YOUR USER CONTENT THAT MAKES YOU OR OTHERS PERSONALLY IDENTIFIABLE.

YOU HEREBY AGREE THAT MIQ HAS NO RESPONSIBILITY OR LIABILITY WHATSOEVER FOR ANY SUCH ACTIVITIES. YOU ALSO AGREE AND UNDERSTAND THAT YOUR USER CONTENT IS NOT SPONSORED OR ENDORSED BY MIQ, AND YOU WILL NOT IMPLY THAT YOUR USER CONTENT IS IN ANY WAY SPONSORED OR ENDORSED BY MIQ.

Security of your Personal Information

Your safety and privacy are of utmost priority to us and therefore we have enabled various tools and technologies for the reactive and proactive protection of your information. It is also essential for us to have your partnership in building a strong and effective defense against potential fraud, money laundering, and associated criminal activities. Some (but not necessarily all) of the steps you can take to protect yourself include:

  1. Ensure you have a strong and unique password for each account and device. Never write it down or save it anywhere.
  2. When it comes to emails, texts, or other electronic messages, avoid clicking a link without validating the sender and confirming that it’s from a trusted source.
  3. Never download or open attachments from an unfamiliar sender.
  4. Never accept an invitation from a user you do not know or have a connection with.
  5. Never share any personally identifiable information or financial information. Miq will only, through official contact, ever request that you share your personal or financial information.

You at any time have the right to withdraw consent to our collection, use, and disclosure of personal information, subject to contractual and legal restrictions and reasonable notice. If you withdraw your consent, certain functionality of the Site may not be available to you, and we may not be able to provide you with certain Services.

Legal age of Use

Our Site is not directed to children under the age of eighteen (18), and we do not knowingly collect information from children under the age of eighteen (18) on our Site. If we become aware that we have inadvertently received information from a visitor under the age of sixteen on our Site, we will delete the information from our records.
